Wisconsin’s election code unequivocally bans ballot drop boxes in the Badger State. Yet after the Wisconsin Election Commission overstepped every aspect of its authority by allowing ballot drop boxes in the 2020 election, three Wisconsin State Supreme Court justices disagreed that state law was binding in the case of drop boxes. Fortunately for Wisconsin voters, the majority opinion upheld statute and confirmed that drop boxes are illegal in Wisconsin. Putting personal political ideology above juris prudence is not new, but as more cases of officials overstepping their authority in regard to election law come before state courts, much hinges on judges adhering to their oaths to uphold state constitutions and laws — and staying within the bounds of the branch of government in which they chose to serve.
